Please thoroughly read through this agreement to understand what information Escape Media Group Inc (”EMG”) collects about you when you use grooveshark.com, twisten.fm, and tinysong.com, and their associated subdomains including but not limited to widgets.grooveshark.com, and listen.grooveshark.com, (the “Site”), as well as any use of any interface EMG may provide for authorized external parties to interact with and make use of a subset of the Sites data and functionality (the “API”), and who EMG may share this information with. Collectively, the Site and the API are hereby referred to as the “Service”. If you find any part of this policy unacceptable, please discontinue your use this site immediately, as this Policy is integrated into, and subject to the Term of Service for the use of the Site (found at http://www.grooveshark.com/tos.php) and the Terms of Service for the usage of the API (found at http://www.grooveshark.com/apitos.php). The use of any or all components of this Service including but not limited to the Site and the API constitutes an agreement between yourself and EMG to knowingly accept and agree to the terms and provisions of this privacy policy.

Definitions

User: For the purpose of the agreement, a user shall be defined as someone who is either directly interacting with the service or someone who is interacting with the service via any third party who is using EMG’s API.
Private information: Data which a user has submitted to this service, or has been accumulated by this service through its use, but is not accessible to a subset or all users (excluding the user who originally created or submitted the data) of the Service or the general public via normal use of this Service.
Personally identifiable information: Data which ties a particular user’s IP address, or full name (meaning both their first and last name), with an action, for example streaming a particular song via this service. If such information is public information, it is not considered personally identifiable or private.
Public information: Data which a user has submitted to this service, or has been accumulated by this service through its use, and is available to be viewed and/or consumed by any user (excluding the user who originally created the data) of this service or a subset of the systems users (excluding the user who originally created the data), or the general public. This may include, but is not limited to information on a user’s public profile, tags, comments, and or ratings submitted by a user.

Information we collect and who can access it:

Public and private information: To provide the needed data to make this service possible, EMG collects and stores information that includes but is not limited to user information submitted during sign up, profile information, and music library information and its accompanying information such as tags, ratings, articles, and comments. EMG stores this information for an indefinite amount of time. This information will not be shared with any 3rd party without consent from the user, or unless otherwise stated in this policy or the Terms of Service.
Public information and the API: EMG may provide authorized external parties with an API to interact with this Service. EMG may share a subset of, or all your Public information via this API. EMG may continue to share your Public information with the external party for an indefinite period of time.
Private information and the API: Should you choose to provide any external service, software, or website the password you use to access this Service, you are authorizing EMG to share all of your Private information not listed in “Exhibit A: Protected Private Information” with said service. EMG may continue to share your private information with the external party for an indefinite period of time.
Personally identifiable information: When you use this service, information about your computer’s request is saved by EMG. This data may include information such as IP address information. IP address information is stored for no more that 6 months from the date the information is recorded. This data may be stored for longer, up to an indefinite amount of time, if EMG is so ordered to do so by a United States court of law with proper jurisdiction. This may be done without any notification to the user. This information may also be kept longer than 6 months by EMG if a user is found by EMG’s soul judgment to be suspect of carrying out illegal, unlawful, or dangerous actions with or in this service. Prior to keeping IP address information for more than 6 months, the user will be notified via email about their suspect status.

In addition to recording information involving a user’s ip address as described above, EMG collects and stores personally identifiable information that includes but is not limited to information that links music streams to particular users and information that links users and there corresponding actions on the Site and/or Service. This information is needed to enable certain features the service provides, and is stored for an indefinite period of time. Private information will not be shared with any 3rd party without consent from the user, or unless otherwise stated in this policy or the Terms of Service.

You should also be aware that if you voluntarily disclose personally identifiable information on message boards, in chat areas, or other openly viewable parts of the service, that information can be viewed publicly and can be collected and used by third parties without our knowledge and may result in unsolicited messages from other individuals or third parties. Such activities are beyond the control of EMG and this policy.
Anonymous information: EMG records anonymous information about users of the service which is stored for an indefinite period of time. This information records only general trends and does not link any statistic with any particular user. This data may include, but is not limited to, averages and or totals of browser and operations system types, entry and exit pages, user, artist, or album popularity, demographic information, and amount of data transferred. This information may be shared with any 3rd party EMG chooses at any time and for any length of time (including make this data available via the API).

Advertising

Advertisers are given no special use of user’s private information unless otherwise stated in this policy or the Terms of Service. If you choose to follow an advertisement link, do so at your own risk. EMG does not guarantee the safety or accuracy of any 3rd party site, advertisement, or product. Advertisers also have their own set of privacy and Terms of Service policies that much be carefully reviewed.
EMG may provide any 3d party it chooses with public user information.
EMG may allow 3d parties to place cookies and other tracking technologies, such as web beacons, clear GIFs, web bugs, tracking pixels on the Site for the soul purpose of allowing that 3d party to record that a User has visited the Site and/or used the Service.

General

EMG reserves the right to revise/alter this agreement at any time with no notice given. Any updates will be posted to this page, with the last updated information changed accordingly.
Escape Media Group, Inc. does not knowingly collect or solicit Personally Identifiable Information from or about children under 13 except as permitted by law. If we discover we have received any information from a child under 13 in violation of this policy, we will delete that information immediately. If you believe Escape Media Group, Inc. has any information from or about anyone under 13, please contact us at privacy@escapemg.com.
This Agreement and the relationship between you and EMG shall be governed by the laws of the State of New York without regard to its conflict of law provisions. You and EMG agree to submit to the personal and exclusive jurisdiction of the courts located within the State and County of New York.
You hereby indemnify and hold harmless, and upon EMG’s request, defend, EMG its affiliates (and their respective directors, officers and employees) from and against any and all losses, liabilities, damages, costs or expenses (including reasonable attorneys’ fees and costs) arising out of any external party gaining access and or utilizing EMG’s API in a way which violates EMG’s API TOS (link).
